1. Introduction and Acceptance of Terms

These Terms of Service (these “Terms”) govern the use of services, facilities, products, and related offerings provided by NOA CAFE Ginza, located at 5-8-5 Ginza, Chuo-ku, Tokyo 104-0061, Japan (“NOA CAFE Ginza,” “we,” “us,” or “our”). By entering our premises, placing an order, using our Wi-Fi or power-seat services, purchasing products, or otherwise using our services, you agree to be bound by these Terms.

3. User Obligations and Responsibilities

Users must comply with all applicable laws, regulations, public health guidance, and store rules while using our services or being present on our premises. In particular, users shall:

Prices for products and services are displayed in Japanese yen unless otherwise stated. Applicable taxes, including consumption tax, may be included or added depending on the manner of display and the transaction method used.

• Payment is generally due at the time of purchase or as otherwise instructed by our staff.

To the maximum extent permitted under Japanese law, NOA CAFE Ginza shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of opportunity, or business interruption, arising out of or relating to the use of our services.

Our liability for direct damages, if any, shall be limited to the amount actually paid by the user for the relevant product or service giving rise to the claim, except in cases where such limitation is not permitted by law.

We do not guarantee uninterrupted access to Wi-Fi, seating availability, power outlets, menu items, or specific ingredients. Service interruptions may occur due to maintenance, network issues, weather, supply shortages, or other operational factors.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited under applicable law, including liability for willful misconduct or gross negligence where such limitation is not legally effective.

All content associated with NOA CAFE Ginza, including but not limited to names, logos, menus, photographs, illustrations, website content, text, designs, trade dress, and other materials, is owned by or licensed to NOA CAFE Ginza and is protected under applicable intellectual property laws.

• Users may not copy, reproduce, distribute, modify, publish, transmit, display, or create derivative works from our content without prior written permission.
• Trademarks and service marks used by NOA CAFE Ginza may not be used in a manner that causes confusion or suggests endorsement.
• Any user-submitted feedback, suggestions, or reviews may be used by us for business purposes without compensation, to the extent permitted by law and subject to applicable privacy obligations.
